GEORGIA WORKERS’ COMPENSATION:
KNOW YOUR RIGHTS!

If you have been injured on the job, it is imperative that you let the employer know immediately. Georgia law requires that you advise your employer regarding any on-the-job related injury within 30 days. However, we recommend you notify the employer (Supervisor/Manager/Boss/Foreman/HR Representative), much sooner than that, immediately if possible. Also, it is important to note there are specific time limitations by which you must file a claim with the State Board of Workers’ Compensation, in order to receive compensation. We recommend that if you have suffered an on-the-job injury that you contact an attorney immediately to protect your rights. Consultations with our firm are always free. Our office is located in Austell, Georgia but we represent injured workers in all counties in the state of Georgia including Cobb, Douglas, Paulding, Fulton, Dekalb, Gwinnett, Clayton Carroll, Bartow, Cherokee, Haralson, Floyd, Polk, Fayette, Coweta, Rockdale, Forsyth, and others.

You may also be entitled to specific benefits from companies that have workers’ compensation coverage you can check here to verify coverage: https://sbwc.georgia.gov/online-employers-workers-compensation-coverage-verification

If you are unable to work for more than 7 days, you should begin receiving income benefits within 21 days after the first day of missed work (currently up to $675.00 maximum Temporary Total Disability)

Additionally, you are entitled to select a physician (authorized treating physician) from the posted panel of physicians for medical treatment. If the workers’ compensation claim is deemed “accepted” by the insurance carrier, your medical treatment will be paid for by the company’s workers’ compensation coverage. Lastly, should you have a permanent disability determined by your authorized treating physician, you will often be given an impairment rating and are entitled to Permanent Partial Disability benefits.

FAQ

Insurance companies prioritize their bottom line, not your well-being. Their initial offer might seem tempting, but it likely won’t cover the full extent of your damages, both current and future. An experienced lawyer will ensure your rights are protected and fight for the maximum compensation you deserve.

The sooner, the better. Evidence can fade over time, and witness accounts become less reliable. A lawyer can start building your case immediately, maximizing your chances of a successful outcome.

Beyond immediate medical bills, you may be entitled to compensation for lost wages, pain and suffering, emotional distress, rehabilitation costs, and future medical expenses. A thorough investigation conducted by your lawyer will uncover the full scope of your damages.

Unfortunately, there’s no one-size-fits-all answer. The complexity of your case, severity of injuries, and cooperation of involved parties all play a role. However, we’ll work diligently to resolve your case as quickly and efficiently as possible, while ensuring a fair outcome.

Everything matters! Keep copies of police reports, medical bills, receipts for related expenses, photographs of the accident scene and your injuries, and any witness statements you can gather. This documentation will be crucial when building your case.

Many personal injury lawyers work on a contingency fee basis. This means you don’t pay anything upfront, and our fees are only collected if we win your case.
